Insurance Coverage
Sunshine Tree carries $1,000,000 in general liability insurance. Our insurance covers accidental damage to above-ground structures, property, and vehicles that may occur as a direct result of our services. Proof of insurance is available upon request.
All crew members are covered under our policy for the duration of services performed on your property. We are licensed and insured in the State of Florida.
Underground Utilities & Subsurface Disclaimer
IMPORTANT: Sunshine Tree is not responsible or liable for any damage to underground utilities, infrastructure, or subsurface elements, including but not limited to:
- •Underground water pipes, irrigation lines, and sprinkler systems
- •Electrical conduits and underground wiring
- •Sewer lines, septic systems, and drainage pipes
- •Gas lines and underground fuel supply lines
- •Concrete slabs, footings, and underground foundations
- •Cable, fiber optic, and telecommunications lines
- •Root barriers and underground landscape features
- •Any other unmarked or unknown subsurface structures
It is the property owner's responsibility to identify, mark, and notify our crew of all underground utilities and subsurface structures prior to the commencement of any services. We strongly recommend contacting Sunshine 811 (Florida's utility notification system) at least 3 business days before any digging or stump grinding services.
Scope of Services & Liability
By engaging the services of Sunshine Tree, the client ("Property Owner") acknowledges and agrees to the following terms:
- Pre-Service Disclosure: The Property Owner agrees to disclose all known underground utilities, irrigation systems, pipes, cables, and other subsurface features before services begin.
- Limitation of Liability: Sunshine Tree's liability is limited solely to direct damages caused by our documented negligence to above-ground property, up to the limits of our insurance policy.
- Underground Damage Waiver: The Property Owner expressly waives any claims against Sunshine Tree for damage to any underground infrastructure, including pipes, concrete, cables, or foundations, unless such damage results from gross negligence following proper disclosure by the Property Owner.
- Natural Tree Fall Zone: For tree removal services, the Property Owner acknowledges that controlled tree removal involves an inherent fall zone and agrees to keep the area clear of all persons and movable property as directed by our crew.
- Property Access: The Property Owner grants permission for our crew and equipment to access the property as reasonably necessary to complete the agreed services.
- Pre-Existing Conditions: Sunshine Tree is not responsible for any pre-existing damage, structural weakness, rot, disease, or conditions present prior to the commencement of services.
Stump Grinding — Special Notice
Stump grinding involves the use of heavy machinery that penetrates several inches below ground level. This service carries a heightened risk of subsurface damage. Before scheduling stump grinding, the Property Owner MUST:
- 1.Contact Florida 811 (dial 811) to have all utilities professionally marked.
- 2.Identify and mark all private irrigation lines, septic systems, and drainage features not covered by 811.
- 3.Inform our crew of any known underground hazards within the work area before work begins.
Failure to follow these steps releases Sunshine Tree from all liability relating to underground damage during stump grinding services.
